The Customer acknowledges that he or she is prohibited from utilizing the service to compromise the security of or to tamper with the Company network, or any information contained on the Company network or any computer utilized by Company, or any other person.

The Customer expressly recognizes that Company cannot and does not guarantee or warrant that files downloaded or information transmitted by means of the Company Network will be free of infection, and the Customer shall be solely responsible for implementing measures in respect of protection against infection, accuracy of data input and data output and for maintaining a means external to the Company Network for the reconstruction or retrieval of lost data.

Company Operating Policies

The Customer hereby warrants that it shall conform to generally acceptable Internet etiquette and that it shall abide by Company operating policies which are set forth below and amended by Company from time to time at Company’s sole discretion, (and the Customer hereby indemnifies Company, and holds Company free from liability, in respect of any loss or damage of whatever nature caused as a result of any breach of such warranties) which policies include but are not limited to the guidelines set out below:

Customer agrees not to engage in any abuse of e-mail or spamming, including but not limited to, the posting or cross-posting of unsolicited articles and blog messages with the same message (or substantially the same message) to more than 5 (five) recipients that did not request to receive such messages;

Customer agrees not to post or transmit any message, data, image or program, which is defamatory, or violates any other personality rights;

Customer agrees not to post or transmit any message, data, image or program, which is offensive, threatening, abusive, harassing, harmful or hateful;

Customer agrees not to post or transmit any message, data, image or program, which violates the intellectual property rights of others;

Customer agrees not to interfere with use of the Internet by any other Company Customers or other users;

Customer agrees not to post or transmit any file, which contains viruses or any other destructive features, regardless of whether or not damage is intended by the Customer;

Customer agrees not to violate the privacy of any person or to violate the security of any system or network, which shall include but shall not be limited to hacking, unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of any system or network, or to breach security or authentication measures without express authorization of the owner of such system or network.

Customer agrees not to solicit, transmit, email or post in any form (‘email, pictures, video, text, news, blog posting’ and so on) containing threatening, abusive, malicious, pornographic, obscene, defamatory or otherwise illegal or inappropriate material. Company reserve the right to take such action as we in our sole discretion deem fit in respect of any otherwise illegal or inappropriate material.

Customer agrees not to resell or make available to third parties, in any manner whatsoever and whether directly or indirectly, all or any part of the services provided to it by Company, without Company’s prior written consent;

Customer understands that any misuse of the blogs and postings of Company can or will result in Company action to deny, restrict, suspend, or terminate your access to all or any part of Company at any time, for any or no reason, with or without prior notice or explanation, and without liability.

Log Files
We use IP addresses to analyze trends, administer the site, track user’s movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. Additionally, for systems administration, detecting usage patterns and troubleshooting purposes, our web servers automatically log standard access information including browser type, access times/open mail, URL requested, and referral URL. Account Agreement

For the purposes of this agreement the term “subscription” should be taken to refer to the schedule of payments made by you, the “user”. The term “account” refers to the personal information that are stored and the application of your submission and promotional efforts on your behalf.

1. Your Account
1.1 Creation – Account creation and activation is subject to the receipt of appropriate payment.
1.2 Payment – Initial billing is submitted upon the completion of the signup process at which point recurring billing is initiated. All future billings will be submitted on the original signup date in all future months. Prices are subject to change; however, you will be notified with 30 days notice, via your supplied contact email address, of any such changes before they go into effect, and you will be given the opportunity to cancel your subscription should you so wish.
1.3 Duration – Your subscription will remain active from the point of account creation to the point at which your account is cancelled in accordance with any of the points detailed in Section 2 (Account Termination).

2. Account Termination
Your account will be terminated under any of the following conditions:
2.1 Subscription Cancellation – Account cancellations can be requested by speaking directly with one of our Opt My Biz representatives via phone. Our Opt My Biz representatives can be reached Monday through Friday, 8am – 5pm PST at 855.678.6929 or 949.274.4760. Please allow two full business days from the point at which your cancellation request is submitted for the request to be processed, at which point all future billings to your account are terminated. Specifically, you will need to request cancellation of your account two (2) days before your next date of submission and billing in order to avoid being charged for an additional month of service. Following cancellation, service will continue, and applicable sponsored links will remain listed, until the end of the account’s payment cycle. Requests for immediate removal of sponsored links will be honored but will not result in a partial refund as outlined in (4.6).
2.2 Subscription Payment Failure – If a due account payment fails to be made, your account may be closed. Potential reasons for account payments failing include the card number changing, the card expiring, your billing address having changed, or having insufficient funds available. You can update your billing information at any time by calling us at 855.678.6929 or 949.274.4760, emailing us at info@optmybiz.com with your updated information. In the case that we are unable to authorize a charge, our payment system will continue to attempt charging your card each day. You may receive a warning email that your account will be suspended if authorization cannot be achieved which encloses directions on the methods to rectify the situation and provide us with updated billing information, if necessary. After this point, your account may be terminated within a specified period of time.

3. Acceptable Use of Service
3.1 – It is the responsibility of our users to create, maintain and police the content of their websites, including obeying all local, regional and national laws. Sites found in violation of any laws may be removed from the Opt My Biz service at any time without notice or refund. If you have questions about the acceptable use of the Opt My Biz service, please contact us through email at info@optmybiz.com to inquire. Opt My Biz, cannot be held liable or accountable for content on user’s sites.
3.2 – Due to policies set forth by the major search engines, Opt My Biz does not accept sites that fall into the following categories: sites that promote or facilitate copyright violations; sites that sell fake, counterfeit or replica products; spamming; get rich quick; MLM; or unacceptable business practices.
3.3 – Opt My Biz reserves the right to refuse service to anyone.

4. Refunds Policy
Per the Opt My Biz Guarantee, the refund policy of Opt My Biz is bound by the following conditions:
4.1 – Refunds may be provided in other cases where the company management determines that there has been a failure on the part of Opt My Biz to fulfill the terms of this agreement, and are granted on a case-by-case basis.
4.2 – We provide no other explicit guarantees regarding results from our service. Specifically, we provide no guarantees as to hits, sales, rankings or other metrics.
4.3 – Partial refunds will not be issued regardless of the point in the payment cycle at which cancellation occurs. Service will be carried out, and applicable sponsored links will remain listed, until the end of the account’s payment cycle. Requests for immediate removal of sponsored links will be honored with the acknowledgment that this will not result in a partial refund for unused services.
4.4 – Refunds will be issued for charges incurred after cancellation, provided a cancellation confirmation code, or other proof of previous cancellation, is presented.

5. Updates to the Opt My Biz Account Agreement
5.1 – This Account Agreement is subject to change, and may be modified by Opt My Biz at any time.

AdWords is Google’s advertising product, which displays your ads to people looking for products or services similar to those that you offer on Google or its partner sites. Advertising with AdWords allows you to reach new customers at the precise moment they’re searching for your type of products and services. You can choose to be charged for clicks, impressions, or conversions, depending on the type of campaign you run.

How to work with a third-party partner

Third-party partners will often charge a fee in addition to the cost of your advertising. Remember, they’re providing a valuable service by managing your AdWords campaigns, providing you with reporting, answering your questions, and optimizing your campaigns, among many other things. We believe it’s important for you to understand the total cost of your AdWords advertising, including any fees your third-party partner charges. Use this amount to determine your return on investment (ROI).

Here are five quick tips for being a savvy customer:

1. Be selective When selecting a third-party partner to work with, look for companies that display a Certified Partner or a Premier SMB Partners badge. You can use Google Partner Search to verify that a company is certified, or to search for certified partners. As part of your selection process, be sure that you understand and are comfortable with the length of the contract you’re entering into with the partner. There are a few other criteria to help you choose the right third-party partner for you:

Has this third-party partner worked with businesses in your area before?
What about businesses with similar budgets or target audiences?
What other services can they provide – alongside AdWords – to grow your business?
2. Pick one partner You may be tempted to divide your budget among multiple third parties to see which one drives the best results. You’re welcome to do this as long as you test them one at a time. Google doesn’t display more than one ad for a business on a page of search results, so you’ll find it difficult to test multiple third parties at once.

3. Educate yourself Understanding AdWords at an advanced level can take time, but it doesn’t take much time to learn the basics. Review the “AdWords basics” section below or visit the AdWords Help Center at adwords.google.com/support/aw to learn more. Understanding AdWords will help you make more informed decisions with your third-party partner.

4. Trust experience If you’re working with a company that’s managed hundreds of AdWords accounts, then it’s likely that they’ve developed expertise with AdWords. If they tell you that certain industries have historically higher online-advertising costs or certain keywords might not work for your business, they’re probably speaking from experience.

5. Evaluate your performance Unless you’re focused on branding, what matters most about AdWords is the return on your advertising investment (i.e. the number of new customers coming in the door). So take some time each month to measure what you’re investing, and the results you’re receiving from that investment.

What to watch out for

Many third parties have earned our trust by representing the best interests of their advertisers. There are some third parties that are not acting in this way. Here are some activities to watch out for and let us know about:

Not sharing the cost and performance of AdWords campaigns: You have a right to know, at a minimum, the number of clicks, impressions, and cost of your AdWords advertising.
Guaranteeing ad placement, either on a specific advertising channel or in a specific position: It’s not possible to guarantee a specific ad position on Google.com search results pages. AdWords ad position is determined by an auction and changes dynamically with every new search. Some third parties may only charge you if they achieve your desired ad placement, but those that guarantee a specific position (i.e. the top position every time a user searches for your keyword) are misrepresenting how AdWords works.
Claiming to be from Google: Ask this person for their name and to email you from their Google.com email address; if you’re still unsure, forward the email to the address above.
Harassing or bullying you into signing up: Only you can remove your business from the natural or organic search results on Google.com.
Deceptive pricing: The agency may not use the correct advertising budget as agreed with you — make sure that you get an official copy of your agreement in writing.
Claiming AdWords will affect your organic or natural ranking: AdWords advertising has no impact on your organic or natural ranking in the search results; the two are completely separate.
AdWords basics

Keywords: The words or phrases you select – when users search for those words on Google, your ad may appear next to or above the search results.
Clicks: The number of times users clicked your ad. Impressions: The number of times your ad appeared.
Clickthrough Rate (CTR): The number of clicks divided by the number of impressions, shown as a percentage. A good CTR can improve your average position.
Average Position: The average position that an ad appears in when it’s triggered. An average position of 1-8 generally means that the ad is appearing on the first page of search results.
Cost: The total amount you spend with AdWords.
Conversion: The action that your advertising results in, such as a phone call, lead, or sale. This is usually a good metric to use to measure the success of your advertising.
